Before you tender on a tax sale

Tenders under the Municipal Act, 2001 require a certified deposit of at least 20% of the tendered amount, submitted in a sealed envelope by the exact deadline. Late tenders are returned unopened.
A tax sale does not extinguish every interest. Crown interests, certain easements, and adverse possession claims can survive the sale — order a title search before bidding.
The municipality does not provide vacant possession. If the property is occupied, removing the occupants is the purchaser’s problem and is governed by the Residential Tenancies Act.
You will almost certainly not be able to inspect the interior before tendering.

General information only, not legal advice. Retain an Ontario real estate lawyer before submitting any tender or offer.
