Before you tender on a tax sale

• Tenders under the Municipal Act, 2001 require a certified deposit of at least 20% of the tendered amount, submitted in a sealed envelope by the exact deadline. Late tenders are returned unopened.
• A tax sale does not extinguish every interest. Crown interests, certain easements, and adverse possession claims can survive the sale — order a title search before bidding.
• The municipality does not provide vacant possession. If the property is occupied, removing the occupants is the purchaser’s problem and is governed by the Residential Tenancies Act.
• You will almost certainly not be able to inspect the interior before tendering.
